TERMS AND CONDITIONS OF OCCUPATION OF ACCOMMODATION

The guest acknowledges that the property is not owned by Umhlanga Holidays who has been given a Mandate by the owner to rent out the property and applies whereby the guest has the right to occupy the flat for the purpose of his/her holiday only. The guest accepts that neither the owner of the property or Umhlanga Holidays is liable for any injuries, loss or damage to personal property that may occur during the guests stay in the apartment, complex or surrounding areas including car parks and garages. Occupancy is entirely at the guests own risk.

The guest agrees to use this property solely for the purpose of a private holiday residence for the maximum of people shown on the booking correspondence and agrees not to:

• use the property for any illegal or immoral purposes and abide by the rules of the property

• to sub-let the property

• cause (nor allow any guests or visitors to cause) any nuisance, annoyance or disturbance to other occupants

• smoke or allow smoking in the property

• bring pets to the property.

Failure to comply with the requirements above will result in the agreement being terminated.

A 50% deposit will be taken at the time of booking. The remainder of the payment is due 1 week before arrival. If arrival is less than 4 weeks from booking the full payment is due when booking to confirm. Value Added Tax will be payable on the services and fees ie. commission, cleaning, repairs and replacement unless the apartment is in a company name where the VAT is charged at the full % . Should the deposit attract bank charges for whatever reason these charges will be added to the account. In terms of the FIC Act 2001 (Act No. 38 of 2001) Umhlanga Holidays is required by law to report any cash payment over 25000.00 ZAR which is either received at our offices or into our bank account or to report any transactions which we may deem as suspicious payments. Umhlanga Holidays reserve the right to cancel / withdraw any accommodation at our sole discretion, for whatsoever reason once the accommodation booking is confirmed and refund any deposits received.


The Guests will pay a refundable damages deposit stated in the booking correspondence to Umhlanga Holidays and the preferred method of payment is either by EFT, credit card or cash. Umhlanga Holidays has Credit Card facilities. The damages deposit will be refunded without interest to the Guests within 14 days of their vacation of the property, under deduction of all reasonable costs for remedying any damage to the property or the contents thereof incurred by Umhlanga Holidays on behalf of the owner as a result of the actions of the guests. This includes the reasonable cleaning costs in event that the property is left in a dirty or very untidy condition. Unclaimed deposits will be considered prescribed after 12 months.


If a cancellation is received for any reason within 30 days of the start date of the booking, payment in full is due, unless the property is re-let for the period. Should the property be re-let for a reduced fee or period, the guest will be liable to pay the difference between the original agreed payment and the reduced fee for the re-let. Should the property be re-let in full, the payment will be refunded. If a cancellation is received for any reason up to 30 days before the start date of the booking, the deposit will be funded. All the booking fee charges will be forfeited.


The property will be available for occupation from 2.00 pm on the date of arrival unless a separate agreement is reached. The way in which the keys will be delivered or collected will be stipulated on the Booking Form or will be agreed when the final payment is received. No keys will be released until the full payment has been received. The property shall be vacated by 9:30 a.m. on the departure date unless a separate agreement is reached. Keys will be returned in accordance with arrangements made when the keys are provided.


The properties are mostly non-smoking and shall be left in a clean and tidy state. Rubbish should be disposed of as explained in the instructions within the property. An excess cleaning charge will be applied should it be required.


The guest agrees to repair, replace or pay for any items damaged through neglect, misuse, or carelessness on the part of the guest or any visitors to the property. Once the guests have taken occupation the onus is on them to ensure that the property is looked after and secure and when damage occurs, either by negligence on their part or deliberate action of a guest, the guest agrees to indemnify the Landlord and Umhlanga Holidays against any associated losses and injury, including lost income and the sourcing of alternative accommodation should that be required.


It is the responsibility of the guests to check the inventory on arrival and that any breakages during the occupancy are reported to the agents and replaced before departure. The guest will notify Umhlanga Holidays of any repairs which become necessary and allow the access to for the repairs to be carried out.


If for unforeseen circumstances a property becomes unavailable for a confirmed booking, then the guest will be informed as soon as possible. Where we are made aware in advance that renovations are taking place in a particular building, should this be deemed to impact you, then we will notify you of the situation in advance, and where possible we will relocate you. There will be no compensation for noise or inconvenience arising from the above. Where possible the guest will be offered similar or higher standard accommodation. If this alternative is unacceptable to the guest, the guest is then entitled to a refund of monies paid to date. Umhlanga Holidays liability is limited to monies paid to date.


The guest agrees to these Terms and Conditions by payment of the deposit and accepting the booking.


In compliance with the POPIA act which is valid from the 1st July 2021, Umhlanga Holidays has appointed an Information Officer and will promote the protection of personal information of all guests. Guests will be informed regarding which information they are required to provide and the reason. This information will not be retained longer than is necessary for achieving the purpose for which it was collected and measures are in place to safeguard against the information being used for any other purpose.
